Mechanism for regulating transactions of liquefied petroleum gas agencies
The sequence of procedures followed when requesting the establishment of liquefied petroleum gas distribution agencies:
First: Establishing a new gas agency
- The concerned party submits an application to the Energy and Minerals Regulatory Authority regarding establishing a gas agency within a specific area.
- The Energy and Minerals Regulatory Authority conducts a physical inspection of the Gas Agency office site and provides the initial approval or disapproval. In the event of approval, an official letter is sent to the concerned parties with initial approval of the proposed location of the Gas Agency, provided that security approval, initial regulatory approval of the distribution office, and defense approval are brought. Civil Defense on the location of the Gas Distribution Office, a copy of the official letter is sent to the Civil Defense Bureau, and the Prevention and Self-Protection Department is addressed with a copy of the Energy and Minerals Sector Regulatory Authority’s letter from the Civil Defense Bureau.
- The Directorate of Civil Defense, under whose jurisdiction the Gas Agency office is located, will be contacted with a copy of the official letter from the Energy and Minerals Regulatory Authority by the Prevention and Self-Protection Department so that the necessary action can be taken.
- The administrative governor in the concerned region shall address the Civil Defense Directorate to express his recommendations on approving the location of the LPG cylinder distribution office.
- A sensory inspection is conducted on the proposed location of the LPG Cylinder Distribution Agency office, and the results of the inspection are documented on the initial approval form for the proposed location of the Gas Distribution Agency office.
- If the office location is initially approved according to the form, the Prevention and Self-Protection Department will be contacted with the initial approval of the office location by the relevant prevention department in the concerned directorate.
- The Department of Prevention and Self-Protection addresses the Civil Defense Bureau to address the Energy and Minerals Sector Regulatory Authority with initial approval of the location of the LPG Cylinder Distribution Agency office.
- The administrative governor is contacted by the relevant prevention department in the relevant directorate for initial approval of the office location.
- The Energy and Minerals Regulatory Authority, after completing all the documents required for the initial approval, including the initial approval by the Directorate of Civil Defense, issues a permit to establish an agency for the distribution of liquefied petroleum gas cylinders, sent to the concerned parties and a copy of it to the Directorate of Civil Defense. The official letter requires several conditions, including obtaining approval from Civil Defense, and a copy of the official letter is sent to the Civil Defense Bureau. The Prevention and Self-Protection Department is addressed with a copy of the Energy and Minerals Sector Regulatory Authority’s official letter by the Civil Defense Bureau, and the concerned directorate is addressed with a copy of the Energy Sector Regulatory Authority’s official letter by the Prevention and Self-Protection Department.
- The head of the Prevention and Self-Protection Department in the relevant directorate transfers the transaction to inquiries so that the necessary action can be taken once the concerned parties are reviewed.
- A sensory inspection is carried out on the office site and its distribution vehicles, and the inspection results are documented.
- In the event that the required identification papers are completed and the test result is positive, approval is provided to establish the gas agency. Then the concerned party signs a written commitment and attaches it to the transaction. The Prevention and Self-Protection Department is addressed by the relevant prevention department in the relevant directorate to approve the establishment of the petroleum gas cylinder distribution agency. Accordingly, the Department of Prevention and Self-Protection addresses the Civil Defense Bureau to address the Energy and Minerals Regulatory Authority with approval to establish an agency for distributing liquefied petroleum gas cylinders, noting that distribution cards for vehicles belonging to the agency are not provided except after obtaining an operating license from the Energy and Minerals Regulatory Authority.
- The Energy Authority provides the agency owner a license to operate an agency distributing liquefied petroleum gas cylinders, and a copy of it is sent to the Civil Defense Bureau. The Prevention and Self-Protection Department is addressed with a copy of the operating license by the Civil Defense Bureau, and the concerned directorate is addressed with a copy of the operating license by the Prevention Department, and accordingly, the distributor is provided with a permit for gas distribution vehicles issued by the relevant directorate, valid from the date of its issuance until the end of the year, with validity to 31/03 of the following year.
In the event that the inspection result is not consistent, the concerned party will be provided with a copy of the inspection report to correct his situation, and once corrected, the above-mentioned steps will be returned.
Second: Requirements of the LPG Distribution Office:
- The property must be used commercially or industrially, and if the use is other than that, the approval of the competent municipality or the Amman Municipality must be obtained.
- The distance of the office from public places (places of worship, schools, hospitals, gas stations, warehouses storing hazardous materials) is a distance of no less than 50 square metres.
- The office area should not be less than 16 square meters, and it should be located on the ground floor, and its floor should be higher than street level to prevent rainwater.
- Powder extinguisher (12 kg), 2 pieces + first aid box.
- Electrical installations are of the non-sparking type.
- Ventilation should not be less than 12% of the office area.
- Post a sign showing the trade name of the agency and the name and number of its owner, and install a plate containing the numbers of the agency’s distribution vehicles in a prominent place inside the office, and install a plate for the necessary telephones (the Authority, the Directorate of Public Security, Civil Defense, etc.).
- There are no wooden decorations or other flammable materials inside the office, and the office furniture consists of (a desk, a chair, and an iron cabinet for storing files).
Third: Requirements for LPG distribution vehicles:
- A valid copy of the distribution vehicle license in the name of the agency owner or one of the partners.
The car must be a single cab or a cab and a half, with a capacity of (1-2.5) tons and a blue color.
- The necessary documents to establish a new agency.
- In the event that there are heirs, the name of a valuable representative is determined to supervise the agency and he submits a special legal power of attorney for that purpose.
Fifth: Instructions for introducing new gas distribution vehicles:
When requesting the introduction of a new LPG cylinder distribution vehicle, the following is requested:
- A request submitted by the agency owner.
- A copy of the new car license that is valid and meets the conditions.
- A physical inspection is conducted by the Civil Defense Directorate, which has jurisdiction over the vehicle to be entered, so that it meets the Civil Defense conditions (requirements for liquefied petroleum gas distribution vehicles, the number of cars allowed to work in the agency). If the conditions are met, approval is given.
Sixth: Instructions for moving the location of the LPG cylinder distribution office:
When moving the location of the LPG cylinder distribution office, the following is required:
- The necessary documents to establish a new agency mentioned previously.
- The inspection is conducted by the Civil Defense Directorate, which has jurisdiction over the office, so that it meets the Civil Defense conditions, and accordingly, approval is provided.
Seventh: Stopping the gas supply based on the request of the concerned party:
- Submitting a request from the agency owner requesting that the gas supply to his agency be stopped.
- Signing a written statement, if his situation is corrected, to re-supply the agency with gas within a maximum period of (6) months. Otherwise, the file and the agency restrictions will be cancelled.
Eighth: Renewal of a gas agency license:
The following documents are required to approve the agency license renewal:
- A copy of a valid profession license or submit a written statement to bring it after obtaining civil defense approval.
- A copy of the license of the vehicle/distribution vehicles operating at the agency.
- A valid certificate of membership in the Gas and Fuel Syndicate.
- Trade name registration certificate.
- Distribution office requirements.
- Distribution vehicle/vehicle requirements.
- The inspection is conducted by the Civil Defense Directorate, which has jurisdiction over the gas agency, and accordingly, approval is given to renew the license.
